Terms of Service - Effective 2020

Terms of Service Agreement for Food Tours & Free Walking Tour


This Terms of Service Agreement ("Agreement") is entered into by and between [Hawaii Free Tours LLC] ("Operator") and the individual ("Customer") participating in any tours / service (“Tour(s)”) provided by the Operator. By booking a Tour with the Operator, the Customer agrees to be bound by the terms and conditions set forth in this Agreement.

1. Booking and Payment:


1.1. Booking: Customers can book a food tour through the Operator's website, authorized agents, or directly with the Operator. Bookings are subject to availability.


1.2. Payment: Payment for the food tour is required at the time of booking. The Operator accepts payment through approved methods such as credit card, PayPal, or other designated payment options.


2. Cancellations and Refunds:


2.1. Cancellations by Customer: Customers may cancel their booking up to 24 hours prior to the scheduled tour date to receive a full refund. Cancellations made within 24 hours of the scheduled tour date may result in a partial or no refund, at the discretion of the Operator.


2.2. Cancellations by Operator: The Operator reserves the right to cancel or reschedule a food tour due to unforeseen circumstances such as inclement weather, insufficient bookings, or other factors beyond the Operator's control. In such cases, Customers will be offered the option to reschedule their booking or receive a full refund.

3. Tour Participation:


3.1. Health and Safety: Customers are responsible for ensuring they are in good health and able to participate in any Tours. Customers with dietary restrictions or allergies must inform the Operator in advance.


3.2. Conduct: Customers are expected to behave in a respectful manner towards the Operator, tour guides, and fellow participants. Any disruptive behavior may result in removal from the tour without refund.


4. Liability:


4.1. Assumption of Risk: Participation in any Tours involves certain inherent risks, including but not limited to accidents, injuries, and food-related illnesses. Customers voluntarily assume all risks associated with participation.


4.2. Limitation of Liability: The Operator shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or in connection with any of the Tours, including but not limited to personal injury, property damage, or loss of enjoyment.


5. Intellectual Property:


5.1. All content and materials provided, including but not limited to logos, photographs, and written descriptions, are the intellectual property of the Operator and may not be reproduced or distributed without prior written consent.
